1.5 Promoter
  The Promoter is ELECTRONIC ARTS WORLD II LLC – TAIWAN BRANCH with office address at 5/F, No. 89, Section 2 Tiding Blvd., Neihu District, Taipei, Taiwan ("Promoter").
   
2. WHO MAY ENTER
  Entry into this Competition is open to Taiwan residents who have pre-ordered Need for SpeedTM Shift on EA Store Taiwan and who have attained at least the age of 13 (provided that, where an Entrant has not attained the age of 20, the Entrant has obtained the prior written consent of his or her parent or legal guardian to enter the Competition) other than employees of the Promoter, its related companies and agencies associated with this Competition and members of their respective immediate families* (each an "Eligible Entrant").
  *"Immediate family" means spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the employee.
  No entry fees or charges are payable to enter the Competition except for the ordinary price paid for the pre order of Need for SpeedTM Shift for participating in the Competition.
   
3. ENTRANTS BOUND BY CONDITIONS
  By entering this Competition, Entrants agree to be bound by these Conditions.
   
4. ENTRY INSTRUCTIONS
   
4.1 Your can enter this Competition by placing a pre-order of Need for SpeedTM Shift on EA Store Taiwan between 9/2 and 9/14 and you will be automatically enrolled if you meet the requirements as set forth in Section 2 above. Entry instructions form part of these conditions. No fees or charges are payable to enter this Competition.
   
5. TIME
  All times in these Conditions are Taipei Standard Time.
   
6. DURATION
  The Competition will commence at the Competition Start Time and will end at the Competition End Time. No entries submitted after the Competition End Time as set out in Condition 1.1 will be accepted.
   
7. NUMBER OF ENTRIES PER ENTRANT
  Entrants may only submit one entry for this Competition.
   
8. PRIZES
  The Prizes for the Competition and the order in which they will be awarded are set out in Condition 1.4.
   
9. PRIZE CONDITIONS
  If the number of valid entries is less than the number of Prizes available to be awarded for the Competition, then the Promoter will be entitled only to make available the number of Prizes corresponding to the number of valid entries.

Entrants must, if requested to do so by the Promoter and as a condition to being awarded any Prize, sign and return to the Promoter (or, in the case of an Entrant under the age of 20, procure that his or her parent or legal guardian signs) any Affirmation of Eligibility to Enter, Declaration of Ownership of Competition Entry, Release and/or Compliance Statements provided to such Entrant by the Promoter. The failure to return such signed documentation may, in the Promoter's sole discretion, result in the Entrant's entitlement to the Prize being forfeited, in which case another Entrant may be selected as the winner of that Prize.

While the value of a Prize has been specified in Condition 1.4, the Entrant acknowledges that there may be variations beyond the control of the Promoter in the actual value of the Prize between the Competition Start Time, Competition End Time and the time that the Prize is awarded.

Except with the written consent of the Promoter, Prizes are not transferable or exchangeable. The Promoter has absolute discretion as to whether to provide such consent and is under no obligation to provide any reasons to any person for providing, or withholding, consent. In no circumstances can non-cash Prizes be taken as cash.

In the event that any Prize is unavailable, the Promoter reserves the right to substitute the Prize with cash or another prize of equal or greater value.
   
10. TAXES
  Any taxes which may be payable as a consequence of an Entrant receiving a Prize are the sole responsibility of the Entrant. The Promoter also has a withholding tax obligation under the laws of Taiwan for prizes awarded with a value of NT$13,340 or greater. The withholding tax rate is 15% for citizens and residents (those legally resident in Taiwan for more than 183 days in the calendar year in which the Prizes are awarded) and 20% for non-residents. The Promoter shall advise an Entrant of any withholding tax due when providing notification of entitlement to a Prize and an Entrant becoming entitled to a Prize with a value of NT$13,340 or greater must remit the applicable withholding tax to the Promoter prior to the actual awarding of a Prize. In the event of a cash Prize or a Prize with a cash element, the Promoter may elect to instead deduct the withholding tax from the Prize and pay the remaining amount to the Winner. The Promoter shall remit the tax withheld on behalf of an Entrant to the competent tax authorities in Taiwan. Failure by an Entrant to remit the applicable withholding tax to the Promoter within 14 days of notification being sent may, at the Promoter's sole discretion, result in a Entrant's entitlement to the Prize being forfeited, in which case another Entrant may be selected as the Winner of that Prize
   
11. NO QUALIFY, ETC, REPRESENTATIONS
  The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods offered as Prizes.
   
12. WINNER NOTIFICATION AND PUBLICATION
  The Winners will be notified by email using the contact details provided in completing the application for the Competition or, in the case of EA Members, using the email address recorded in their EA membership record, as soon as reasonably practicable after the conclusion of the Random Draw
The names of the Winners will also be published on the Promoter's website in accordance with Condition 1.3.
   
13. EXCLUSION OF LIABILITY
  To the extent permitted by law, the Promoter is not responsible or liable for:
 
(i) inaccurate entry information;
(ii) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, or incomplete;
(iii) any problems or technical failures of any kind, including malfunction of any communication network or lines, computer online systems or network, servers or providers, computer equipment, or software;
(iv) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;
(v) unauthorised human intervention in any part of the Competition;
(vi) electronic or human error which may occur in the administration of the Competition;
(vii) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to a Winner; or
(viii) any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in the Competition.
   
This condition does not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the Prize supplied again.

The Promoter's decision is final on all matters and no correspondence will be entered into.
   
14. TAMPERING AND OTHER FAILURES
  If for any reason the Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or who may benefit form such tampering, and/or to cancel, terminate, modify or suspend the Competition.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
   
15. PRIVACY
  Entrant personal information ("PI") will be collected to enable the Promoter to administer and promote the Competition and its winners and, if an entrant consents, may be used to market its products and services to the entrant. The PI of winners may be provided to others assisting, including prize suppliers and deliverers. Entrants may contact the Promoter at the address given below to request access to any of their collected PI that is still held. If an entrant does not truthfully provide all requested PI, the Promoter may determine that they are not eligible to win a prize.

If any entrant wishes to request access to their PI or to correct it, the entrant may email or send a written request to the Privacy Administrator in his or her country of residence as set out on http://privacyadmin.ea.com.
   
16. ENTIRE AGREEMENT
  These conditions constitute the entire agreement of the parties relating to the entry into and the conduct of the Competition.
   
17. GOVERNING LAW AND JURISDICTION
  These Conditions are governed by the laws of the Taiwan and the parties submit to the exclusive jurisdiction of its courts for the resolution of any dispute, difference, controversy or claim arising in connection with these Conditions or the Competition.
